Five Eritrean citizens have filed a lawsuit in the civil court in Rome against Italian authorities for what they claim was an illegitimate pushback to Libya on July 2, 2018.
Five Eritrean citizens, with the support of the Association for Juridical Studies on Immigration (ASGI) and Amnesty International Italia, have filed a suit with the civil court in Rome against Italian authorities, the private company Augusta Offshore and the skipper of one of its vessels, the Asso Ventinove.
According to a statement published on February 12 by ASGI, the plaintiffs claim that on July 2, 2018 they were pushed back to Libya by the ship Asso Ventinove run by Augusta Offshore as part of operations coordinated by Italian authorities in collaboration with the so-called Libyan coast guard.

The Court of Rome ruled that the readmission procedure enacted at the eastern Italian border based on an accord between Italy and Slovenia in 1996 is illegitimate. Judges upheld an appeal brought by a Pakistani asylum seeker who arrived in Trieste and was readmitted in July to Slovenia, then to Croatia and then to Bosnia.
Readmissions of migrants from Italy to Slovenia are illegitimate, ruled the Court of Rome in an ordinance on January 18 when it upheld an urgent appeal brought by a Pakistani asylum seeker.
The man had arrived in Trieste and was readmitted in July 2020 to Slovenia, from there to Croatia, and further on to Bosnia. Judges said the man has the right to immediately enter Italy to apply for asylum.

Italy faces growing criticism following reports that it has returned migrants back across its border with Slovenia. Slovenia and the Balkans region at large have been facing accusations of violent pushbacks, which have been investigated by various human rights groups in recent years.
Various human rights groups have reported that once migrants find themselves returned illegally from Italy to Slovenia – a European Union member state – they run the risk of further being pushed back through Croatia all the way to Bosnia and Herzegovina, which is not an EU member.
There are reports of violence and abuse involved in these so-called pushbacks, which are against international law, not only because of their violent nature but also because they hinder would-be asylum seekers from asserting the right to have a fair asylum process in Italy.
