Road Accident Fund wants 102 law firms probed for not returning R340m sent by mistake

PHOTO: Aaron Ontiveroz/Getty Images The Road Accident Fund (RAF) is on a collision course with over 100 law firms over duplicate payments made to them.   The RAF has written a letter to the Legal Practice Council (LPC) to lodge a complaint, and to ask it to investigate 102 law firms. The RAF alleges the law firms owe just more than R340 million paid into trust accounts in error.  RAF spokesperson William Maphutha said the ailing entity wanted to recover money from the law firms as part of its turnaround plans. A senior partner at a top South African firm is being investigated for attempting to mislead the Supreme Court in a trademark infringement dispute.  Gérard du Plessis, who was chair of Adams & Adams for eight years (stepping down in March this year), acted for Nivea in a trademark dispute. Nivea succeeded in the Supreme Court of Appeal in South Africa, as the judges ruled that a shower gel by Connie Bodycare (a company owned by actress Connie Ferguson) was confusingly similar to Nivea s product.  However, the Supreme Court of Appeal has now reported du Plessis to the Legal Practice Council for allegedly attempting to mislead the judges, according to a report in The Times, South Africa.

In an email seen by City Press, RAF senior legal manager Gontse Baloyi wrote to the Legal Practice Council to institute investigations in terms of section 37(1) of the Legal Practice Act into the conduct of 102 law firms that owe the RAF a combined R340 060 277.97 as of March 1 2021. Attorneys are not protecting the interests of children who are due settlements. The judge has reported an attorney and a court appointed “curator” to the Legal Practice Council. Judge Denise Fisher in the Gauteng High Court has criticised the Road Accident Fund and some attorneys for acting unlawfully when concluding settlement in matters involving children, with no proper scrutiny of their circumstances or of who actually looks after them, and who will protect their financial interests.
