Federal eviction moratorium thrown out. Is NY s ban still in place? View Comments A judge struck down a federal eviction moratorium Wednesday, but that won’t affect New York’s recent extension of its own moratorium to Aug. 31, state lawmakers said this week. The federal moratorium was first enacted last spring and was extended by the U.S. Department of Health and Human Services through the Centers for Disease Control and Prevention. President Joe Biden extended it again to June 30.  Meanwhile, New York enacted its own moratorium in December, which was extended to Aug. 31 by the state Legislature earlier this week.

The COVID-19 Emergency Protect Our Small Businesses Act of 2021 was then signed in January to protect small businesses also experiencing financial hardship.

NY lawmakers extend Covid eviction moratorium through August Updated May 04, 2021; By Denis Slattery | New York Daily News Albany, N.Y. The measure continues a temporary stop on evictions and some foreclosures for renters and landlords who can attest that financial hardship due to the pandemic has prevented them from paying rent or mortgage.

Governor Andrew Cuomo hasn’t said whether he’ll sign the bill, but lawmakers expect he will because he signed the last one in March. The moratorium was set to expire on May 1st. If approved on Monday as expected, the new retroactive legislation will extend two separate laws: one that applies to small businesses, and the other a pause on residential tenant evictions and foreclosure proceedings.
