Norfolk Southern Gets Arbitration In Attendance Policy Fight

ADVERTISEMENT ADVERTISEMENT Norfolk Southern Gets Arbitration In Attendance Policy Fight Law360 (February 9, 2021, 9:50 PM EST) A disagreement over changes Norfolk Southern Railway Co. made to its attendance policy must play out in a grievance and arbitration process instead of in court, an Illinois federal judge ruled Tuesday, saying the dispute qualifies as minor under the Railway Labor Act. In a decision granting Norfolk Southern summary judgment in its suit against the International Association of Sheet Metal, Air, Rail and Transportation Workers, Senior U.S. District Judge Elaine Bucklo said the dispute involves the interpretation of the parties collective bargaining agreement. Under the RLA, those types of disputes are minor and must go through the arbitration and grievance.

Transit Unions to DHS: Give America A No Ride List

Transit Unions to DHS: Give America a “No Ride” List SHARE We’re just 15 days into 2021, and the number of really bad, anti‐liberty policy and legislative proposals are multiplying like mold spores. To that end, I would direct you to the request by the International Association of Sheet Metal, Air, Rail and Transportation Workers that the Transportation Security Administration (TSA) create a “No Ride” list for passenger rail akin to TSA’s infamous “No Fly” list for the airline industry. From the unions’ press release: Suspected insurrectionists continue to threaten further violence as the transition to President‐elect Joe Biden’s administration approaches next week. Some of these have been relegated to the No Fly List overseen by FAA, preventing them from traveling by air, but no such restriction exists for the national passenger rail network. SMART-TD and BLET urge that a “no‐ride” list that mirrors FAA’s list be enacted immediate

A Look at Phase One of Metro NextGen Bus Service Reorganization

As I explained in my earlier post, NextGen implementation will be during three consecutive service adjustments (December 2020, June 2021, and December 2021). The service adjustment, or “shake-up,” is Metro’s semi-annual process by which operators bid on driving slots awarded based on seniority per the SMART (the International Association of Sheet Metal, Air, Rail and Transportation Workers) union collective bargaining agreement with the agency; service changes are generally implemented as part of the shake-up. The current service adjustment is deliberately less ambitious than the next two rounds will be in order to ease the system into the process, according to Metro staff. But it is also reflective of the short interval between October board approval of the planned service changes and now. [Find the detailed board report on the changes here; find the staff presentation on them here.]
