“That was relief; it was a triumph,” Barry said, “but very quickly it became, What shoe is going to drop now? There always seems to be some stumbling block, some reason this has not been accomplished, and there always seems to be something else.”
That something else came Friday when the teacher’s union sued the district. The union maintains that state law forbids schools from reopening if they had not already reopened before the county moved into the most-restrictive purple tier.
Those who want schools to reopen, however, argue that the district can reopen under the purple tier because the campuses had reopened for the most vulnerable students prior to the county s shift back to the purple tier.

ENCINITAS, CALIF. (KGTV) The return to in-person instruction for some north county students appears to be in legal limbo.
Friday, the California Teachers Association filed a legal petition on behalf of the union representing the teachers in the San Dieguito Union High School District.
The union wants the district s reopening plan blocked, saying, among other things, it violates the state s public health rules concerning the pandemic.
Last Tuesday, the school board voted to give students the option of returning to in-person instruction five days a week on January 27th. Previously, the board voted to return to campus one day a week beginning January 4th.
On Dec. 17, a group of San Dieguito Union High School District students protested for a safer reopening of their schools, sending a message that they want their voices heard and to ensure that their teachers are protected. The students held signs that read: “Keep us safe,” “We stand with our teachers”, “If you don’t act like adults we will” and “You can’t put kids first if you put teachers last.”
The protest was prompted by the board’s decision on Dec. 15 to expand the reopening of schools to five days a week on Jan. 27 and due to board member Michael Allman questioning the value of student input as they determine reopening plans.

the district’s plan violates state rules because the state forbids schools from reopening if they did not reopen before the county fell into the most restrictive preventive stage, dubbed the purple tier. San Diego County has been in the purple tier since Nov. 10.

The Carlsbad City Council met Tuesday and gave final approval, 4-1, to its hotel employee recall rights ordinance. Reports were presented on the city’s 2019-20 annual financial audit results and on upcoming municipal service reviews by the Local Agency Formation Commission (LAFCO) of the city of Carlsbad and Carlsbad Municipal Water District. Marissa Steketee was appointed to the Parks & Recreation Commission.

The Del Mar City Council met in closed session Monday to discuss litigation. In open session, the council discussed its 6th Cycle Housing Element and the penalties involved for not fulfilling its obligations, which could include reduced state funding, increased legal costs and financial penalties, and less local control over development. Planning Department staff also answered questions submitted by the community about various housing sites and alternatives.
