A new lawsuit could soon be filed in connection with the death of Kristin Smart.
KSBY spoke exclusively with the Smart family attorney, Civil Attorney James Murphy, on Thursday, who said he is planning on filing a separate lawsuit for intentional infliction of emotional distress against Ruben Flores by the end of next week.
In 1997, Murphy filed a wrongful death lawsuit against Paul Flores on behalf of the Smart Family.
Over the years, judges have allowed the lawsuit to move forward.

The Grover Beach man accused of the brutal murder of an Oceano activist repeatedly interrupted the judge at a hearing today to espouse his innocence, before he pled not guilty.
James Krause, 41, is charged with the brutal murder of 90-year-old Lawrence Albert Bross of Oceano. On Jan. 24, 2019, one of Bross’ neighbors found his battered body in his home. He had been beaten and stabbed.
After detectives identified Krause as a suspect in this case, DNA evidence identified Krause as the killer, according to the San Luis Obispo County Sheriff’s Office.

Podcaster Chris Lambert is getting national attention for his role in helping the San Luis Obispo County Sheriff s Office in its Kristin Smart investigation.
The creator of “Your Own Backyard” spoke to Good Morning America Wednesday.
During the interview, Lambert said he is relieved that the San Luis Obispo County Sheriff took action and arrested Paul and Ruben Flores after almost 25 years.

Paul Flores, 44, was formally charged with first-degree murder in connection with her death, according to San Luis Obispo County District Attorney Dan Dow, who announced the charges after new evidence recently came to light in the case. So what I can tell you is that significant new information has come in to the sheriff s office that we ve read over the last two years, and some very important information just a month ago, Dow said at a news conference Wednesday.

In a press briefing April 14, San Luis Obispo County District Attorney Dan Dow announced formal first-degree murder charges against Paul Flores in connection with the 1996 disappearance of Cal Poly student Kristin Smart.
Dow said his office believes Paul Flores killed Smart while attempting or committing rape, but he cannot be charged for rape because the statute of limitations has expired.
The DA also announced that Paul’s father, Ruben Flores, is charged with accessory to murder after the fact.
“The allegation against Ruben is that he helped to conceal Kristin’s body after the murder was committed,” Dow said.
Dow said his office has carefully reviewed the case and concluded, independently of the San Luis Obispo County Sheriff’s Office, that they have enough evidence to prosecute both men.
