Judge leaves door ajar for Huguely appeal

An evidentiary hearing will be held for George Huguely V in Charlottesville’s federal court after his counsel claimed that a dictionary was improperly consulted by the jury that convicted him of second-degree murder in 2012. Huguely, a former University of Virginia lacrosse player, was found guilty in Charlottesville Circuit Court in 2012 in the slaying of Yeardley Love, who also played lacrosse at UVa and was Huguely’s on-again, off-again girlfriend. She was found dead in her apartment in May 2010, two weeks before she and Huguely were set to graduate. In the years since the trial, Huguely has attempted to appeal the case in several instances, and in 2015, he appealed the case up to the U.S. Supreme Court, which refused his petition for certiorari on his claim that the circuit court denied his right to counsel by forcing him to proceed in the absence of his retained counsel of choice.

(WVIR) -The Charlottesville Circuit Court building has recently been awarded Leadership in Energy and Environmental Design (LEED) Gold certification. The project achieved LEED Gold by minimizing landfilled waste during construction and integrated sustainable materials. Also, the building optimizes energy performance, like auto-shutoff lights and water-saving measures. The building is projected to achieve energy cost savings of almost 35%. The project includes a new courtroom, holding cells, renovated offices, a new elevator, and other ADA upgrades. These renovation, as well as the roughly 9,000-foot addition, is the first significant improvements that have been made to the building since it was constructed back in 1962.

Brackney cites experience in interview for Dallas job

Charlottesville Chief of Police RaShall Brackney, a finalist for Dallas, Texas’ top law enforcement position, highlighted her law enforcement experience during a recent virtual public interview for the position. Brackney is among seven finalists for the position and was selected from a pool of 36 applicants, according to KRLD. She is the only woman finalist and one of two who work outside of Texas. She has declined to comment on the her candidacy since the news broke on Dec. 11. If she is offered and accepts the position, it will continue a churn of top leadership in the city since the Unite the Right rally.

On November 30, Judge Bobby Downer of the Charlottesville General District Court ordered the City to pay Kessler’s court costs for violating his FOIA rights. But Judge Downer demurred on delving into the destruction of documents issue, which he said had to be decided by the Circuit Court. Accordingly, the new Kessler lawsuit renews his request for a Writ of Mandamus, this time seeking to compel the City to recover the destroyed documents by any means necessary, including hiring a forensics and eDiscovery firm to recover the data. The new Kessler lawsuit [ Kessler v Jones, Thomas, et al (PDF)] filed December 11 in Charlottesville Circuit Court, seeks an admission that Charlottesville officials violated the law, specifically the Public Records Act and Freedom of Information Act, by destroying public records that were relevant to ongoing litigation involving Unite the Right.
