They will meet the RAF and its chief executive Collins Letsoalo in the Gauteng High Court, Pretoria, on June 15, where they will ask for an interim interdict to prevent the entity from implementing the new directive. Their lawyer, Jean-Paul Rudd of Adams and Adams, said in court papers issued this week that they would ask the court to review and set aside the directive, which was issued in March.

This directive, issued in March, will remain in place, and whoever lodges a claim without the required list of annexures, will be turned away and told to return once all the necessary documents are at hand. This is according to RAF chief executive Collins Letsoalo, adding that there would be no exceptions. Letsoalo said the RAF had a host of “skeleton claims” which could not be finalised as the claim handlers had not received the required documents.

This as the government agency embarks on its transformation journey. The RAF issued a minimum requirements directive in March this year, informing plaintiff attorneys and claimants of the list of compulsory documents required as part of the lodgment process.

Health Department’s R105bn headache By Bongani Hans Share Durban - The National Department of Health is facing legal claims of more than R105 billion for medical negligence involving law firms whose clients are dissatisfied with the amount of money due to them from the court settlement amounts. Health portfolio committee chairperson Dr Sibongiseni Dhlomo said litigations had left the department with a liability of about R26bn, while Minister Zweli Mkhize told the committee that the department had settled R500 million of the claims last year. The auditor-general’s 2019-2020 report revealed in March this year that the government was facing litigation claims totalling R147.12bn. Most of the claims, R105bn, were related to medical negligence.
