Chemical Co. Wants To Skip IP Damages Trial After Sanctions
Law360 (June 15, 2021, 7:38 PM EDT) An oilfield chemical company that got Western District of Texas Judge Alan D. Albright to impose sanctions on a rival for concealing evidence of infringement asked the judge Monday to award it $17 million, instead of holding a damages trial.
In May, Judge Albright entered a so-called death penalty sanction of default judgment against True Chemical Solutions LLC by finding it liable for willful infringement of Performance Chemical Co. s patents and attorney fees based on egregious misconduct that came to light on the eve of a planned March 26 trial, and then scheduled a trial for damages on July 19.

Law360 (May 24, 2021, 4:46 PM EDT) U.S. District Judge Alan Albright on Friday permanently enjoined True Chemical Solutions from infringing Performance Chemical Co. s oil and gas delivery trailer patents as punishment for concealing evidence that it installed automation technology in its trailers, and scheduled a damages trial for July.
Friday s order finalized and gave a detailed explanation for the Texas federal judge s April 6 decision to sanction True Chem by putting it on the hook for willful infringement and attorney fees without trial. Judge Albright said it appears that True Chem altered its trailers for a court-ordered inspection and instructed employees to lie about the use of.

MIDLAND, Texas Whenever there is a need, West Texans always show up. Performance Chemical made a huge drop off as one final push for the NewsWest 9 United Supermarkets Salvation Army Toy Drive.
When the company heard that donations for the toy drive were down this year, company leadership issued a company challenge to all employees. A truck load of toys and bikes were collected and donated to the NewsWest 9 studio.
