Court directs IT officials to return ₹5 cr with 12% interest

‘Document relating to cash seizure prepared by officer was fabricated’ Observing that seizure of ₹5 crore by Hyderabad Income Tax officials nearly 18 months ago from a private company employee was illegal, the Telangana High Court directed them to refund the money within four weeks. The order was passed by a bench of Justices M.S. Ramachandra Rao and T. Amarnath Goud in two writ petitions, one filed by M/s Mectec and the other by its employee Vipul Kumar Patel. The bench also directed the Director of Income Tax (Investigation) - Hyderabad and the Deputy Director of IT Unit-I (3) to pay an interest of 12% per year to the company from the date of seizure of the cash till date of refund of the money.

The court had already given directions with regard to one ranker on Monday. A division bench comprising Justices M.S. Ramachandra Rao and T. Amarnath Goud gave the interim direction in this regard based on the plea of the rankers that they were denied opportunity to participate in the phase-2 counselling following their admission in Siddhartha Medical College, Vijayawada, a state-wide institute, where Telangana state has specific quota for 10 years after bifurcation.

Radhakrishnamurthy by the ACB special court. A bench of Justices M.S. Ramachandra Rao and T. Amarnath Goud passed the direction after hearing a writ petition filed by Radhakrishnamurthy. Anti-Corruption Bureau (ACB) officials arrested the petitioner in April of 2018 on charge of receiving ₹ 7 lakh bribe to grant bail to an accused facing charges under NDPS Act. The petitioner was then serving as Nampally Criminal Court Additional District Judge. ACB officials subsequently filed charge-sheet in the case. The petitioner’s counsel contended that ACB registered case against the judge following a complaint lodged by a lawyer. The ACB authorities did not seize any cash from the judge, the lawyer argued.
