BELLEVILLE – St. Clair County Associate Judge Kevin Hoerner entered nine straight orders in favor of paraquat plaintiffs in preparation for a trial he would have started Monday, May 10.
The parties asked for a delay over the weekend, and Hoerner granted it.
In rulings from May 3 to May 6, he limited testimony of 17 defense experts and entirely excluded two.
He denied all defense motions for limits on testimony.
Farmers Carroll Rowan, Jerry Mills, Freemon Schmidt, and Ronald Niebrugge claim they suffer Parkinson’s disease from using paraquat to control weeds.
They seek damages from Syngenta Crop Protection and Growmark cooperative as suppliers, and Chevron USA as manufacturer.

Chevron Can Deduct Costs From Royalties Under Lease
Law360 (May 11, 2021, 6:37 PM EDT) A Pennsylvania federal court shut down a suit alleging Chevron bilked a mineral estate owner out of royalties, finding on Tuesday that the company was authorized to deduct post-production costs when calculating payments under the lease agreement.
U.S. District Judge William S. Stickman IV granted Chevron USA Inc. and Chevron Appalachia LLC s motion to dismiss a suit brought by mineral estate owner Coastal Forest Resources Co. The suit accused the lessees that operate on its Marcellus Shale mineral estate in southern Pennsylvania of wrongfully subtracting post-production costs from its royalty payments.
