SCOTUS Decision on Arizona Election Law Is the Good News Now for the Bad News

On July 1, the Supreme Court delivered its opinion in Brnovich v. DNC. In a 6-3 decision, SCOTUS upheld two commonsense provisions in Arizona’s election law. Ballot harvesting, which often involves partisan operatives collecting absentee ballots and delivering them to a polling location, will remain illegal in Arizona. Voters will also still be required to cast their votes in the appropriate precinct. This ruling is a positive sign for how SCOTUS may rule on other lawsuits regarding election law. The decision signals that a majority of justices would likely not overrule state law if the election provisions are applied neutrally, and the state offers many opportunities to vote. As Jason Snead, executive director of Honest Elections, noted:

Supreme Court Decision Could Encourage More State Voting Restrictions, Legal Expert Says

The U.S. Supreme Court on Thursday upheld two Arizona voting provisions that opponents had claimed discriminated against minority voters. One of the provisions requires voters to vote only in their precinct. The other makes it illegal for someone other than a family member to turn in a person’s absentee ballot. In a 6-3 decision, the court said neither provision violates the federal Voting Rights Act. But Steve Vladeck, Supreme Court expert and professor at the University of Texas School of Law, told Texas Standard the Voting Rights Act is “a shell” of what it once was. He says the 1965 landmark legislation was severely weakened in recent years by another Supreme Court decision.

Cornel West: Manchin s Bipartisanship Is Like Crackpipe

Cornell West had some advice for Sen. Joe Manchin (R-WV) that he hoped would help the senator understand that Republicans will not work with Democrats to pass voting rights legislation such as the For the People Act or the John Lewis Voting Rights Act. Both bills are opposed by Republicans in the evenly split 50-50 Senate, where 60 votes are required to get past a threatened filibuster to start or end debate. Don Lemon played an excerpt from a CNN interview with Manchin from earlier in the evening to get West’s reaction. “Ok what do you think?” Lemon said. “He’s saying he still wants to work with Republicans to get it done. Is the choice now between the filibuster and democracy?”
