Effective April 29, 2021, Georgia courts and the Georgia Tax Tribunal are prohibited from granting any deference to the Georgia Department of Revenue’s interpretation of the tax law, unless that interpretation has been formally adopted as a rule under the Georgia Administrative Procedure Act (“APA”). S.B. 185, 2021 Leg., Reg. Sess. (Ga. 2021).
Taxpayers in Georgia (and in other states with similar practices) should be aware that they are now on equal footing with the taxing authority, and that the taxpayer’s interpretation of an ambiguous statute will be accorded the same weight as the taxing authority’s interpretation. Administrative agencies will have to promulgate formal rules in Georgia to be granted any judicial deference and will otherwise be held to the same standard to which taxpayers have always been held in advancing their construction of the tax law. MOULTRIE, Ga. â Colquitt Regional Medical Center began accepting 2021 pre-applications for unlimited contribution amounts through Georgia HEART Rural Tax Credit Program on May 17.Â
These will be submitted to the Georgia Department of Revenue in the order in which they are received beginning July 1 at midnight, according to a press release from the hospital.

ATLANTA - Gov. Brian Kemp urged consumers not to stock up on fuel as gas stations run short on supply and prices steadily rise. My main message to Georgians today is that the most effective way to address the fuel shortages we are experiencing is for everyone to remain calm and only get the fuel you need to carry out essential activities, said Gov. Kemp. Please do not go out and fill up every five gallon can that you have. Doing so will only mean this shortage will last longer and more Georgians will be unable to make it to work, take their kids to school or get to their medical appointment.
