Biden creates commission to study packing the Supreme Court

AP Photo/Cliff Owen President Biden signed an executive order today which sets up a new commission to study changes to the Supreme Court, including the possibility of expanding/packing it. The full order is posted on the White House website. It creates a commission of 36 members all of whom are considered experts in the legal field. The group will have up to 180 days to submit a report which looks at specific reform proposals and which will include public comment. The full list of members is here. Most of them aren’t household names but a few, like Harvard’s Laurence Tribe, are familiar. There’s no need to guess where he stands on court packing:

April 09, 2021 President Biden will today issue an executive order forming the Presidential Commission on the Supreme Court of the United States, comprised of a bipartisan group of experts on the Court and the Court reform debate. In addition to legal and other scholars, the Commissioners includes former federal judges and practitioners who have appeared before the Court, as well as advocates for the reform of democratic institutions and of the administration of justice. The expertise represented on the Commission includes constitutional law, history and political science. The Commission’s purpose is to provide an analysis of the principal arguments in the contemporary public debate for and against Supreme Court reform, including an appraisal of the merits and legality of particular reform proposals.
