BEAUMONT – After denying UPS a trial by jury, Judge Kent Walston, a district judge in Jefferson County, awarded the plaintiffs suing the company $27 million in damages for an auto collision that didn’t occur in Texas.

Justices issue mandate in case alleging woman delivered baby into hospital toilet

BEAUMONT – Back in December, the Ninth Court of Appeals affirmed a ruling rejecting an expert report offered by Christus Health Southeast Texas in a lawsuit brought by a patient who delivered her baby into a toilet while admitted to St. Elizabeth Hospital.

Jefferson County Man Sentenced on Felony Sex Abuse Charges

This week a Jefferson County man was sentenced on charges resulting from a February court case. Michael Alexander Coon appeared in Jefferson County District Court and was sentenced on two convictions of child sexual abuse, each a class B felony, and one count of child endangerment, an aggravated misdemeanor. The charges stem from Coon’s sexual abuse of a minor girl when she was six and seven years old, beginning in 2018. He was given 25 year prison sentences for each sexual abuse count to run concurrently and two years for the child endangerment charge, resulting a 27 year sentence. He will be eligible for parole after serving 70% of the sentence, in 2040. Conditions for his parole include successful completion of the Department of Corrections Sex Offender Treatment Program, lifetime special parole for sex offenders and placement on the Iowa Sex Offender Registry.

Suit alleges trucker fled scene after smashing into vehicle, Ferguson Law representing plaintiff

Dishon BEAUMONT  - A driver for the Davis Transfer Company allegedly smashed into another vehicle and then fled the scene, a recently filed lawsuit alleges. Seeking more than $1 million in damages, Crystal Silvey filed suit against DTC on May 7 in Jefferson County District Court. According to the lawsuit, on Feb. 22 Silvey was traveling as a passenger on I-10 in Jefferson County when suddenly and without warning DTC’s driver failed to pay attention to the roadway, traveled into Silvey’s lane and smashed into her vehicle, causing her serious and permanent injuries. After the wreck, a BPD officer conducted a thorough investigation and found the driver to be the sole cause of the wreck. Instead of rendering aid, the driver fled the scene, the suit states.

Provost Umphrey strikes out on appeal, justices affirm Judge Templeton s decision not to grant firm a new trial

Judge Templeton BEAUMONT – Judge Mitch Templeton did not err by opting not to grant a new trial in car wreck suit that resulted in a jury awarding no damages, according to an opinion issued by the Ninth Court of Appeals today. Court records show plaintiff Taylor Carter, who is represented by The Provost Umphrey Law Firm, sued Joseph Pham to recover damages for injuries allegedly sustained in a motor vehicle incident. The case went to trial in July 2019, with jurors finding both parties equally negligent and opting not to award any damage. In October 2019, Carter filed a motion for new trial, which Judge Templeton denied the following month.
