Colorado s New Law To Restrict Teen Marijuana Use Faces Legal Challenge

The parents of a medical marijuana user in Colorado say a new law that aims to curb young people’s access to highly potent marijuana is unconstitutional.  Nineteen-year-old Benjamin Wann uses medical marijuana to treat his epilepsy. A lawsuit filed earlier this month on his behalf in Denver District Court states that the law is “.unlawfully restricting patients from accessing their constitutionally protected right to the amount of medical marijuana provided.”  The law limits how much medical marijuana adult users can purchase per day to no more than eight grams. The previous daily purchase limit was 40 grams. Eighteen- to 20-year-old users could purchase no more than two grams per day.

Second court rules governor is proper defendant in certain lawsuits

A class action lawsuit filed against Gov. Jared Polis by inmates last year can go forward, the Colorado Court of Appeals ruled Thursday. In the lawsuit filed in Denver District Court in May 2020, five current or former inmates of the Colorado Department of Corrections filed suit against the governor as the chief executive of the state alleging that the state failed to protect medically vulnerable prisoners from the threat of the coronavirus. Over the course of the pandemic, numerous inmates at several correctional facilities have contracted the virus, some even dying. A Denver district judge, however, tossed out the lawsuit on grounds that the governor was not a proper defendant and that the separations of power doctrine in the Colorado Constitution doesn’t give the courts jurisdiction to hear such a case.
