The General Court of the European Union (“
General Court”) delivered three Judgments on 16 December 2020 which confirmed different aspects of the scope of the powers enjoyed by the European Commission (“
the Commission”) in its application of competition rules in the European Union (“
EU”). In a nutshell, the General Court has confirmed that the Commission:
is entitled to apply competition rules to sports activities;
has a very wide discretion in determining whether or not there is sufficient “Community interest” for it to pursue an infringement action under Articles 101 and 102 of the Treaty on the Functioning of the European Union (“
TFEU”); and
The enormous tradition and diversity in African agricultural products may benefit from the use of the intellectual property tool for food protection that Europeans have been held most dear.
Over the years, EU countries have mastered the concept of Geographical indications (GIs) which are designed to protect the names of specific products to promote their unique characteristics, linked to their geographical origin as well as to the know-how embedded in the region.
European citizens can find these products on their supermarket shelves labelled with specific labels for local food specialities such as PDO (protected designation of origin) and PGI (protected geographical indication).
I. Introduction
On November 26, the Dusseldorf Regional Court handed down a long awaited decision in the so-called
automotive patent wars (case ID 4c O 17/19). The court referred heatedly debated questions in connection with the enforcement of standard essential patents (“SEPs”) to the Court of Justice of the European Union (“CJEU”). The detailed set of questions addresses two main issues: 1. Whether the entity selling a device (here a car) that includes a component that implements the technology protected by the SEP would be in compliance with the FRAND procedure set out by the CJEU in
Huawei v. ZTE if it were to refer the SEP holder to the upstream component supplier rather than making a fair reasonable and non- discriminatory (“FRAND”) offer itself; and
