Judge temporarily blocks Ohio’s enforcement of fetal remains abortion law

The decision follows a lawsuit filed last month by Planned Parenthood Federation of America, the ACLU, ACLU of Ohio, along with Fanon A. Rucker of The Cochran Firm-OH on behalf of Ohio abortion providers.

COLUMBUS, Ohio - A Hamilton County judge on Monday temporarily halted enforcement of a law requiring fetal remains to be buried or cremated after a surgical abortion.
Last year’s Senate Bill 27, which the legislature passed and Gov. Mike DeWine signed Dec. 30, would have gone into effect Tuesday. But Hamilton County Common Pleas Judge Alison Hatheway’s order prevents the law from taking effect until 30 days after the Ohio Department of Health writes rules which would first require public input and comment around the law.
