Questions are being raised by charity members and experts over the deals, which saw the former Cerebral Palsy Society president and a colleague paid tens of thousands of dollars in fees for masterminding and managing the arrangement, which appears to have left a $2m hole in the society’s finances as services were cut to those most in need.

After carrying out a search warrant on The Safety Warehouse s mobile network service provider, DIA investigators discovered the company had sent more than 4800 messages on August 12, to over 4700 different individuals. The DIA says it s not the first time The Safety Warehouse has landed itself in trouble for unsolicited texts this year. Early in 2020, it issued the company with a formal warning for similar messages, along with information on how to comply with the Unsolicited Electronic Messages Act - but The Safety Warehouse then breached the legislation in August, resulting in a $300 civil infringement notice. Lisa Wilkin-Krug, the DIA s manager for digital messaging and systems, hopes the ruling encourages other businesses to take a look at their approach to marketing, and ensure it complies with the Act.

DIA Issues $30,000 Penalty For Unsolicited Messages

Monday, 21 December 2020, 2:11 pm Te Tari Taiwhenua Department of Internal Affairs (DIA) has issued a penalty of NZ$30,000 to Greenback Ecommerce Limited (trading as The Safety Warehouse) for breaching the Unsolicited Electronic Messages Act 2007 (the Act). The Safety Warehouse was investigated after DIA received complaints from the public about receiving unsolicited commercial SMS text messages. These messages took advantage of the second COVID-19 outbreak to sell face masks and failed to provide an unsubscribe facility. DIA executed a search warrant on The Safety Warehouse’s mobile network service provider and identified over 4,800 unsolicited commercial SMS text messages sent on 12 August 2020.
