Chinese Regulators Order Tech Companies to Standardize Financial Businesses

On April 29, Chinese regulators from the China Banking Regulatory Commission, China Securities Regulatory Commission, and State Administration of Foreign Exchange announced that they have ordered 13 of China’s biggest tech companies, including Tencent and ByteDance, to “standardize” their online financial businesses. Regulators will likely require firms to spin off payments programs and may even eliminate some firms’ insurance, wealth management and lending practices.

In a rule that takes effect on March 16, 2021, the U.S. Department of Commerce’s Bureau of Industry and Security (BIS) has determined to impose additional export licensing requirements in connection with military-intelligence end uses and end users under the Export Administration Regulations (EAR). The rule, implementing the Export Control Reform Act of 2018 (ECRA), covers not only exports of U.S. commodities, software, and technology, but also activities of U.S. persons (both within and outside of the United States) in support of military-intelligence end uses and end users. It also expands existing licensing requirements for activities related to weapons proliferation and provides BIS with authority to further limit a restricted party’s potential access to EAR-controlled items.

Xiaomi won a reprieve Friday when a US federal judge temporarily blocked a ban on investment in the company put in place by the Defense Department over alleged ties between the China-based phone maker and that country s military.
The US national security priorities are undoubtedly compelling government interests, US District Judge Rudolph Contreras wrote in a memorandum accompanying his order to suspend the ban. However, the court is somewhat skeptical that weighty national security interests are actually implicated here.
