U S Fish and Wildlife Service Proposal to Downlist Red-Cockaded Woodpecker: Southern Environmental Law Center Comments | Mitchell, Williams, Selig, Gates & Woodyard, P L L C

The Southern Environmental Law Center (“SELC”) submitted December 7th comments in response to a proposal by the United States Fish and Wildlife Service (“Service”) addressing the red-cockaded woodpecker (“Woodpecker”). The Service has proposed downlisting the Woodpecker. See [Proposed] Reclassification of the Red-Cockaded Woodpecker From Endangered to Threatened With a Section 4(d) Rule, 85 Fed. Reg. 63,474 (Oct. 8, 2020). Section 4 of the Endangered Species Act (“ESA”) and the implementing regulations at Part 424 of Title V of the Code of Federal Regulations set forth procedures for adding species to, receiving species from, or reclassifying species as threatened or endangered. “Endangered species” is defined as any species that is in danger of extinction throughout all or a significant portion of its range.

City Council slated to vote on Richmond 300 plan on Monday

LaToya Gray sees the legacy of urban renewal on a vacant lot where her great-grandparents used to live on Idlewood Avenue before the construction of the city’s highway system started more than 70 years ago. She says the Richmond 300 master plan, intended to guide the city’s growth over the next 20 years, is a step toward correcting a history of decisions that changed the trajectory of countless Black lives. She said new ideas described in the proposed plan would encourage development without further displacing communities that suffered under previous urban planning initiatives. “As someone who has grown up in this city and knows what it’s like to be marginalized . I know how devastating previous master plans have been on the African American community,” Gray said. “The planners were intentional about reaching out to people who were marginalized and included those voices in the process.”

Wood pellet company Active Energy Renewable Power faces legal action over discharges into Lumber River

(File photo: Lisa Sorg) Active Energy Renewable Power, which plans to operate a large wood pellet plant in Lumberton, in Robeson County, faces a potential lawsuit for discharging polluted wastewater for nearly 500 days into the Lumber River and a tributary. The Southern Environmental Law Center, representing Winyah Rivers, formally notified the company on Dec. 10 that it intended to sue under the Clean Water Act. The company has 60 days to respond.
