Brief / July 7, 2021 SAN ANTONIO In a case arising from the 2017 mass shooting at a church in Sutherland Springs, Texas, a federal court ruled the government was 60% responsible for former serviceman Devin Kelley’s attack, due to its failure to operate the National Instant Criminal Background Check System. The Air Force had multiple opportunities to submit Kelley’s fingerprints and criminal history to the FBI, but failed to do so, and Kelley was able to purchase firearms even though he shouldn’t have been able to pass the background check.
