It was incumbent upon Swamy to file an application under the appropriate provision setting out the list of witnesses, along with other specific details, whom he intended to examine, the counsel said. The present application is also liable to be dismissed as the present application does not conform to the relevant provision, ? the counsel told Additional Chief Metropolitan Magistrate Sachin Gupta.
In reply to the application, the accused said that while it was the legal right of Swamy to submit a list of witnesses sought to be summoned by him, the court was not conducting a roving inquiry .

Congress leaders Sonia and Rahul Gandhi Wednesday accused BJP MP Subramanian Swamy of delaying proceedings in the National Herald case, filed by him against them and others, by moving totally vague application. The Gandhis made the submission before the court while opposing an application filed by Swamy, seeking summoning of various documents and witnesses in the case.

NEW DELHI, Dec 21: Journalist-turned veteran Congress leader Motilal Vora, a Gandhi family loyalist who worked with three generations of the family including former prime ministers Indira Gandhi and Rajiv Gandhi, party president Sonia Gandhi and former party president Rahul Gandhi, passed away at the Escorts Hospital here on Monday, just a day after celebrating his 93rd birthday.
His body was being taken to his home town Durg in Chhattisgarh for cremation, a district town where the Bhilai Steel Plant is located and from where Vora started his career as a journalist, associated with many newspapers.
