Patna High Court Seeks Implementation Of HIV Patients Welfare Scheme In The State By April 5

Concerned by non-implementation of Government schemes for welfare of HIV/ AIDS victims, the Patna High Court recently came into action and sought response from the Bihar State AIDS Control Society (BSACS).
In an order dated March 23, a Division Bench comprising of
Chief Justice Sanjay Karol and Justice S. Kumar said that the schemes may be implemented by April 5, the next date fixed.
In this regard, the Bench ordered the Project Director, BSACS, to file his personal affidavit, indicating the steps taken by the society for proper and complete interpretation of various Statute, Rules and Schemes, notified for the benefit of AIDS victims.

1. The Top Court issued Notice on a plea challenging validity of provisions under the Places of Worship (Special Provisions) Act, 1991. Supreme Court Bench led by Chief Justice Bobde issued notice to the Ministry of Law and Justice, Ministry of Home Affairs and the Ministry of Culture. The Act, as alleged, takes away the power of Court and Religious Sects to restore their places of Worship. Challenge has been sought against Sections 2,3,4 Places of Worship (Special Provisions) Act, 1991 on the grounds of Article 14,15,21,25,26 and 29 of the Constitution.
