IMPERIAL â Imperial Irrigation District apparently has decided not to sweat Michael Abattiâs decision to appeal his case against the district to the nationâs highest court.
IID announced Monday it will not file a response to Abattiâs petition to the U.S. Supreme Court over his ongoing legal dispute with the district over water rights. The exception would be if the court requests a response.
IID General Counsel Frank Oswalt said in a press release that a response is unnecessary.
âAfter a thorough review of Mr. Abattiâs petition, it was the unanimous conclusion of counsel that there is almost no possibility that the United States Supreme Court will grant the petition,â he said.

¯ Ruling has not been made on motion to intervene in court order.
¯ Sewer project will affect some 560 homes in Devola.

A notice of appeal was filed Wednesday with the Environmental Review Appeals Commission in answer to the permit to install granted for the Devola Sewer Project.
Greg DeGulis, attorney for the group Devola Against Sewering Homes, said it is an administrative appeal of the director’s decision to grant the permit to install the sewer in Devola.
DASH is made of opponents of the Devola Sewer Project, which will affect about 560 households using either drywell disposal systems or septic tanks for wastewater.
