Treating ordinary run-of-the-mill country bomb cases as terrorist offences and such cases being sent to special courts will defeat the very purpose of the NIA (National Investigation Agency) Act, the Madras high court has said, expressing the hope that such issues will be looked at by the stakeholders with the seriousness they deserve. A full bench of Justices P N Prakash, V Sivagnanam and V N Manjula made the observations while hearing a referral from a single judge asking whether an application against the order passed by a district and sessions court judge concerning the UAPA (Unlawful activities prevention Act) be treated as a bail application or appeal under the NIA Act, even if the case was being investigated by the state police and not the NIA.

The Bench comprising Chief Justice S. Manikumar and Justice Shaji P. Chali passed the verdict while allowing a public interest litigation filed by G. Balagopalan, former Director, Police Fingerprint Bureau, State Crime Records Bureau (SCRB), Thiruvananthapuram, challenging the government order. He contended that allowing the employees who took part in the strike to take leave was illegal and an abuse of power.
