Rent Control Board supports Assemblymember Bloom’s legislation to deter Ellis Act evictions Apr. 13, 2021 at 6:00 am On April 8, members of the Rent Control Board voted unanimously to support AB 854, which strives to limit the use of Ellis Act evictions by speculative property investors. Currently landlords can purchase rent controlled buildings and then immediately use the Ellis Act to exit the rental business, evict tenants, and sell the property for a higher price. Assemblymember Richard Bloom (D-Santa Monica) and Assemblymember Alex Lee (D-San Jose), believe this goes against the original intent of the 1985 Ellis Act, which was enacted to help mom and pop landlords who couldn’t afford to maintain their properties.

The security of millions of California tenants could be decided on Thursday, April 15 as the Assembly Housing Committee votes on AB 854. AB 854 prevents speculator evictions under the Ellis Act, and is the strongest tenant and rental housing protection bill in the legislature this session. Unfortunately, three committee Democrats Jesse Gabriel (Los Angeles), Sharon Quirk-Silva (Orange County) and Brian Maienschein (San Diego) have yet to announce support. Two of their votes are needed. Quirk-Silva helped kill a similar bill in 2014 (See “Assembly Democrats Put Ellis Reform on Life Support” June 19, 2014). But she has since demonstrated great concern about the housing crisis. AB 854 would reform the 36-year-old Ellis Act, a state law that gives landlords the right to remove their units from the rental market, therefore evicting all tenants “without just cause,” according to a Berkeley City Council report from March.
