Hyannis: Two men charged with possession of fentanyl, cocaine and a gun

BARNSTABLE Sitting in Barnstable District Court on Monday, Jordan Maddox watched his friend, Leslie J. Ostapchuk, plead not guilty to firearms and weapons charges. Ostapchuk, 30, and Robert J. Perry, 29, both of Hyannis, were arraigned on charges of trafficking between 36-100 grams of fentanyl, trafficking 18-36 grams of cocaine, conspiracy to violate the controlled substance act, possession of a firearm without a license to carry, possession of ammunition and possession of a large capacity feeding device. Ostapchuk was also charged with possessing a Class B drug, and Perry was charged with a firearm violation with two prior violent/drug crimes, according to a criminal complaint filed in Barnstable District Court. Perry pleaded not guilty to the charges during his arraignment.

Hyannis man was making homemade fireworks not a bomb, lawyer says

BARNSTABLE A 40-year-old Hyannis man charged with possession of explosives was found to be competent to stand trial during a dangerousness hearing Wednesday in Barnstable District Court. Dorian Firth pleaded not guilty during his arraignment Tuesday to one charge of secreting/throwing/launching/placing explosives and one charge of possession of explosives. Firth s lawyer said his client was using the explosives to make homemade fireworks, not a bomb. At about 6 a.m. Tuesday, Barnstable police officers responded to a residence at 119 Baxter Road for a report of a resident who had an explosive device on the premises, Barnstable police said in a statement. The device was found in a bedroom at the house, which is operated by the nonprofit Homeless Not Hopeless.

Tribunal: Evidence supports proceeding with wrongful death suit

BARNSTABLE A medical malpractice tribunal determined there is enough evidence to proceed with a wrongful death lawsuit filed by the estate of a woman who hanged herself at the Barnstable County Correctional Facility in 2017. The tribunal ruled last week that there is “sufficient evidence to raise a legitimate question as to liability appropriate for judicial inquiry” for Correctional Psychiatric Services, the third-party vendor that was hired to handle mental health cases at the jail, and several of its employees, in the case filed by the estate of Jessica DiCesare.  DiCesare, a Centerville mother of two, died by suicide in 2017 at the jail in Buzzards Bay while she was awaiting a hearing on charges of receiving stolen property, driving uninsured and without a license and possession of class C and E drugs.
