Donthe Lucas trial for murder of Kelsie Schelling resumes in Pueblo

The first-degree murder trial of Donthe Lucas is set to resume Wednesday following a two-week break prompted by COVID-19 exposure in a Pueblo courtroom. Lucas, 28, is accused of killing his then-girlfriend, Kelsie Schelling, who disappeared in Pueblo Feb. 4, 2013, after traveling to meet Lucas. Schelling was 21 years old and about 8 weeks pregnant at the time. Trial proceedings were five days underway on Feb. 9, when 10th Judicial District Court Judge Thomas Flesher called for a two-week recess, saying someone in the courtroom tested positive for COVID-19. The 14-day quarantine was recommended to the court by the Pueblo Department of Public Health and Environment.

Pueblo jail capacity, complicated by COVID-19, has consequences

As the COVID-19 pandemic has ravaged jails and prisons throughout Colorado, facilities like the Pueblo County Detention Center have been largely unable to accept new inmates. As a result of several changes, many criminals can repeat their crimes again and again without fear of spending time behind bars, according to law enforcement officers. Since March 24, the 10th Judicial District of Pueblo has had a court order in place to limit overcrowding in the jail, intended to help suppress COVID-19 among personnel and inmates.  The order allows law enforcement to use discretion when choosing whether to arrest and book some criminal suspects involved in civil, misdemeanor, traffic or petty offenses.

Kelsie Schelling murder trial: Donthe Lucas first week in court

For more than eight years, people in Pueblo have pondered a macabre question: What possibly could have happened to Kelsie Schelling? The 21-year-old Denver woman, who was eight weeks pregnant at the time, disappeared in Pueblo on Feb. 4, 2013, after a late-night drive to the Home of Heroes to visit her boyfriend, Donthe Lucas. Schelling has not been seen or heard from since, and her remains have never been found. But the question of what happened to Schelling, as well as who could have orchestrated her disappearance, recently came one step closer to being answered – at least in terms of Lucas’ involvement.

Kelsie Schelling s friend testifies to abusive relationship with Lucas

The court also noted that a single member of the jury had been dismissed due to conflicts. The case is centered upon the disappearance of then-21-year-old Schelling, who was pregnant at the time and in a relationship with Lucas. Schelling had traveled to Pueblo to see Lucas in early February 2013 before she disappeared. In opening arguments, prosecutors noted facts they believe point toward Lucas’ involvement with Schelling’s disappearance. Lucas was not served with a warrant until 2017, when he was charged with first-degree murder while he was already in custody at the Pueblo County Detention Center on an unrelated aggravated robbery charge.
