Pennsylvania Supreme Court Refuses to Remove DA in Cop-Killer’s Case
The Pennsylvania Supreme Court threw out a petition filed by the widow of a Philadelphia police officer who wanted anti-police Philadelphia District Attorney Larry Krasner barred from handling ongoing appeals in the case of convicted cop-killer Mumia Abu-Jamal.
Abu-Jamal, a former Black Panther militant born Wesley Cook, was convicted of the 1981 murder of Daniel Faulkner. During his trial, Abu-Jamal didn’t deny the killing. As Faulkner tried to arrest Abu-Jamal’s brother during a traffic stop, Abu-Jamal shot the white policeman once in the back and then standing over him, shot him four more times at close range, once directly in the face. Multiple eyewitnesses saw the killing.

Early in the morning on November 27, 2001, Termaine Joseph Hicks heard a woman s screaming from an alley behind a hospital in Philadelphia. According to the Philadelphia Inquirer, he entered the alley and found a woman who had been pistol-whipped and raped. He reached into his pocket to call 911, and the next thing he knew he d been shot three times by the police.

On December 16th the Pennsylvania Supreme Court
dismissed the FOP’s King’s Bench petition to remove Philadelphia District Attorney Larry Krasner as the prosecutor in Mumia Abu-Jamal’s criminal case and replace him with Pennsylvania Attorney General Josh Shapiro.
Mumia is contesting his first-degree murder conviction for the shooting death of Philadelphia Police Officer Daniel Faulkner on December 9, 1981. His default opponent in court is the lead prosecutor for the city of Philadelphia: DA Larry Krasner. The recently-dismissed King’s Bench petition argued unsuccessfully that Krasner is biased in favor of Mumia and should be removed.

A significant roadblock to Mumia Abu-Jamal’s appeal of his unjust 1982 murder conviction was removed on Dec. 16, when Pennsylvania Supreme Court justices dismissed an attempt by the Philadelphia Fraternal Order of Police to obtain a change of venue in the case.
With this new ruling, all of Abu-Jamal’s pending appeals and motions in the Pennsylvania Superior Court will move forward from where they left off in February, when the state Supreme Court stayed all proceedings until the justices decided on the FOP’s King’s Bench petition.
