The Philadelphia Fraternal Order of Police Lodge Five & Maureen Faulkner have lost this fight. But the rematch is going to be brutal.
On December 16th the Pennsylvania Supreme Court
dismissed the FOP’s King’s Bench petition to remove Philadelphia District Attorney Larry Krasner as the prosecutor in Mumia Abu-Jamal’s criminal case and replace him with Pennsylvania Attorney General Josh Shapiro.
Mumia is contesting his first-degree murder conviction for the shooting death of Philadelphia Police Officer Daniel Faulkner on December 9, 1981. His default opponent in court is the lead prosecutor for the city of Philadelphia: DA Larry Krasner. The recently-dismissed King’s Bench petition argued unsuccessfully that Krasner is biased in favor of Mumia and should be removed.

With this new ruling, all of Abu-Jamal’s pending appeals and motions in the Pennsylvania Superior Court will move forward from where they left off in February, when the state Supreme Court stayed all proceedings until the justices decided on the FOP’s King’s Bench petition.

Federal prosecutors in Philadelphia have charged four men with murder in connection to the shooting death of Sgt. James O’Connor, who was killed in March while trying to serve a fugitive warrant in Frankford.
Hassan Elliott, the 22-year-old accused of firing the bullets that killed O’Connor that morning, is eligible for the death penalty, according to a seven-count indictment unsealed Thursday. The rare sentence would have to be approved by the U.S. Attorney General and the federal jury empaneled to hear the case at trial.
