Tomorrow will see the new judicial guidelines on personal injury awards, recently approved by the Judicial Council, take effect. The Personal Injuries Assessment Board, which assesses all unsettled claims, will also be adopting them. Monday next, 26th April, the first working day following the implementation of these new guidelines, is D-Day, said Peter Boland, Director of the Alliance for Insurance Reform.

Insurer hikes premium by €1,700 after crash and fails to defend injury claim

A young driver who had her premium hiked by €1,700 after a minor rear-ending accident has criticised her insurer for refusing to defend a personal injury claim brought following the accident.  The 23-year-old was involved in the collision last summer after the driver in front of her braked suddenly. She swerved to avoid the crash but hit the rear of the other vehicle.  There was minimal damage done to her own car and the claimant’s car had some small damage.  No ambulance or gardaí were called to the scene, but two weeks later she received a solicitor’s letter, claiming the other driver suffered “severe injuries”.
