Developer Abe Atiyeh s battle for Bethlehem psych hospital dealt legal win

Developer Abe Atiyeh’s battle for Bethlehem psych hospital dealt legal win Updated Feb 03, 2021; Developer Abe Atiyeh’s quest to develop a 5-acre property at Center Street and Dewberry Avenue in Bethlehem was dealt a legal win in Pennsylvania’s Commonwealth Court. Atiyeh pitched an 80-bed psychiatric hospital on the property by Bethlehem Catholic High School. But the city zoning officer denied the application on the grounds that Atiyeh’s proposed development was actually a treatment center, not a hospital. Treatment centers are not legal uses in the city’s institutional zoning district. Atiyeh then appealed the county court ruling to the Pennsylvania Commonwealth Court, which just ruled in his favor. The court agreed with Atiyeh’s argument that the zoning hearing board was too strict in its interpretation of the zoning ordinance and it did not consider relevant evidence outside of the initial application.
