Defense Bar Seeks Redo Of Pa. Ruling On Shared Liability
Law360 (April 5, 2021, 8:57 PM EDT) More than a dozen defense bar organizations have urged the Pennsylvania Superior Court to grant an en banc rehearing after a two-judge panel said in a recent decision that a state law largely barring joint and several liability only applies when a plaintiff s own negligence is called into question.
Groups including the U.S. Chamber of Commerce and the Pennsylvania Coalition for Civil Justice Reform, as well as several large health care systems, said the panel s decision last month threatened a decade-old understanding that the state s so-called Fair Share Act barred defendants from being put on the hook for the entirety of.
Re-Trial of Paul Ross 9:45 pm
A man Convicted of First Degree Murder nearly 2 Decades ago will again have his day in Court. The Courts are preparing for the long-anticipated re-trial of convicted murderer ‘Paul Ross’.
A Pennsylvania Superior Court ruled that Paul Ross didn’t receive a fair trial back in 2011. Ten years later, the re-trial process has finally come to fruition. Paul Aaron Ross was sentenced in 2005 for the death of Tina Miller in 2004. However, a panel in 2011 said Ross’ Defense Team didn’t have enough time to build their case, and a 2012 panel upheld that ruling. Then, Blair County District Attorney Richard Consiglio’s Appeal was denied in 2013, officially opening the door for a re-trial.

The Pennsylvania SuÂÂpreme Court has upheld the termination of parental rights of a Bedford County man, but the 5-2 decision issued March 26 raised several questions that remain to be answered.
The state’s highest court was reviewing a case in which a father was challenging a decision by Bedford County Common Pleas Court Judge Thomas S. Ling to terminate his parental rights.
The father and mother broke off their relationship shortly after their child’s birth eight years ago.
For three years, the father maintained contact with the child and paid support, but the mother married and she and the boy’s stepfather petitioned the court to terminate the rights of the natural father so the stepfather could adopt the child.
