While the Belgian Data Protection Authority (“DPA”) is becoming increasingly active in adjudicating GDPR claims and releasing opinions and recommendations, companies are still finding it difficult to implement the complexities of the GDPR in their businesses.
In order to provide greater legal certainty and guidance to companies, a proposal for a law on ‘Privacy Rulings by the DPA’ was introduced on March 4, 2021, in the Federal Parliament of Belgium. A Privacy Ruling by the DPA would offer certainty for a company on how to apply the GDPR to a specific situation (cf. tax rulings from the FPS Finance). The Privacy Rulings would be published anonymously and could also become a separate source for other companies to verify their compliance.
