A Saskatoon Court of Queen’s Bench judge has quashed a distracted driving ticket that was given to a man who held and viewed his cellphone after pulling over and parking during a roadside police stop.
Justice Grant Currie ruled the traffic court judge erred in his definition of “driving,” and that driving, like parking, “should be interpreted in accordance with common usage.”

The driver appealed his traffic court conviction for using a cellphone while driving, arguing that the common usage of the word “driving” connotes a vehicle being “in motion.” When it is not in motion, it must be considered “parked,” he said.
