Cabinet mulling reduced penalty for cultivating marijuana

Taipei, March 10 (CNA) The Cabinet said Wednesday it is considering a proposal to reduce the minimum five-year prison sentence for marijuana cultivation, as part of a review being conducted in line with a Constitutional Court ruling.
Under Article 12 of the current Narcotics Hazard Prevention Act, the minimum penalty for growing marijuana is five years imprisonment and a fine of up to NT$5 million (US$176,312), regardless of the circumstances.
In a case dating to 2014, a man surnamed Lin (林) was sentenced to two years and six months in prison for growing marijuana in single pot at his home, in ruling made under a separate provision in Taiwan s Criminal Code.
