Legal bid to scrap governmentâs BBE requirements in Covid-19 vaccine roll-out

Pretoria - Although there have been delays in the roll-out of the countryâs Covid-19 vaccination process, this has been caused by factors outside the governmentâs control.
In addition, South Africa remains on track to vaccinate the entire adult population within 12 months.
This is according to the Director-General of Treasury, Dondo Mogajane, in his answer to an application by AfriForum, in which it claims that the BBE requirements for entities to purchase vaccines will slow down the process.
The lobby group is asking the Gauteng High Court, Pretoria, to direct Finance Minister Tito Mboweni to use his discretion in terms of the Preferential Procurement Policy Framework Act, in exempting all state organs that purchase and sell goods and services related to the vaccine programme from the usual BEE requirements.

Johannesburg - Finance Minister Tito Mboweni has defended the governmentâs use of preferential procurement legislation to empower black businesspeople previously disadvantaged by apartheid at the Constitutional Court.
Mboweni is challenging the Supreme Court of Appeal s (SCA s) ruling that declared Preferential Procurement Policy Framework Regulations 2017 invalid and unconstitutional in favour of AfriBusiness, now known as Sakeliga, in October last year.
In heads of argument filed by Mboweniâs counsel Ngwako Maenetje, SC, and Mkhululi Stubbs on April 19, the minister argues that the SCA erred in that it measured the legality of the 2017 regulations solely against the requirements of section 217(1) of the Constitution.
