HELENA, Mont. - A Senate Joint Resolution was announced requesting a study, presentation and review of the adequacy of the Montana Womenâs Prison Facility and Programs by Sept. 15, 2022.
The building currently used as the Montana Women s Prison was purchased by the Department of Corrections in 1994 and previously served as a psychiatric hospital before being converted to a prison facility according to SJ 26.
SJ 26 also says the last major expansion of the Womenâs Prison was in 2003, and the prison has 250 beds and houses about 225 felony inmates.
In addition, the resolution says a significant number of inmates at the prison are American Indian, that access to equal programming for educational opportunities and job training is not adequate or equal to the men s facilities and that the Montana Women s Prison has an aging inmate population and lacks a geriatric facility comparable to that for male inmates.

After more than 30 years, and two decades since Blackwell began hormone therapy, her chance to leave arrived last fall when groundbreaking legislation gave transgender, intersex and nonbinary inmates the right, regardless of anatomy, to choose whether to be housed in a male or female prison.

At least five current or former Polk County Jail inmates have accused a medical provider there of sexually abusing them.
Plaintiffs Rod Mundy, Clayton Shaw, Robert Gaitlin, Anthony Garcia and Robert Stephenson each have filed lawsuits claiming Dr. Michael J. Daly sexually assaulted them in his private office at the Polk County Jail.
Stephenson s lawsuit was filed in June 2020 and alleges an assault in June 2018. The four other cases have been filed since February and describe incidents in early 2019.
The men remain in custody at different state and federal facilities. Attorney Erik Luthens, who is representing all five men, said a few more cases have yet to be filed. The first five cases were each brought just before the two-year statute of limitations expired.
