Arizona employers are now expressly prohibited by state law from discriminating against employees on the basis of pregnancy or childbirth. On January 28, 2021, the Arizona Legislature passed, and on Thursday, February 4, 2021, Arizona Governor Doug Ducey signed into law, HB 2045, which amends the state civil rights statute to clarify that existing statutory prohibitions on sex-based discrimination also preclude discrimination on the basis of pregnancy and childbirth. Rock Havenâs top administrator is firing back after employees spoke out about the staff exodus that has come in the wake of the county-run nursing homeâs controversial COVID-19 vaccine mandate.
In an email to The Gazette, Rock Havenâs interim administrator, Sara Beran, said some Rock Haven employees have floated a âfalse notionâ that layoffs and resignations tied to the vaccine mandate have cut deep enough into the ranks of nursing staff to put residents at risk.
That is even as employees this week have continued to tell The Gazette theyâre strained under the exit of workers who either quit or were laid off after they refused to take the Moderna COVID-19 vaccine Tuesday.

The mandate requiring employees of Rock Haven to get the COVID-19 vaccine remains in place after hours of debate by the Rock County Board.
It passed an amended resolution late Thursday night to allow the mandate to continue, with exemptions for reasonable accommodation under the Americans with Disabilities Act, Civil Rights Act and Pregnancy Discrimination Act of 1978.
Thirteen board members voted yes, four voted no, and 11 abstained. Many board members changed their votes to abstentions after the majority of the votes were cast in a roll call.
The change in policy would allow the nursing home employees to keep their jobs without getting the vaccine if they qualify for the exceptions laid out in those federal protections.
