Veteran election lawyer Romulo Macalintal, who is also Vice President Leni Robredo’s lead counsel, said on Tuesday, May 11, that only “luck” will reverse the ruling of the Supreme Court (SC) that junked the electoral protest filed by former Senator Ferdinand Marcos Jr.

In February, the SC, acting as the Presidential Electoral Tribunal (PET), dismissed unanimously the entire Marcos’ poll protest against Robredo regarding cheating and fraud allegations during the 2016 vice presidential race.
“Mr. Marcos would be the luckiest man in the world if he could reverse the unanimous decision by merely repeating the same issues and arguments already decided by the entire Presidential Electoral Tribunal,” Macalintal said.

Published May 11, 2021 12:12pm Former Senator Ferdinand “Bongbong” Marcos Jr. has asked the Presidential Electoral Tribunal (PET) to reverse its decision junking his election protest against Vice President Leni Robredo. Marcos appealed the decision on Monday even if the PET which is composed of all justices of the Supreme Court has already voted unanimously to uphold Robredo’s victory in the 2016 election due to the former senator’s failure to make a substantial recovery of votes and present proof of irregularities. In his motion for reconsideration, the former senator insisted his third cause of action the annulment of 2016 election results for vice president in Lanao del Sur, Basilan, and Maguindanao could proceed independently from the manual recount and judicial revision.

Former Sen. Ferdinand “Bongbong” Marcos Jr. asked the Presidential Electoral Tribunal (PET), composed of all Supreme Court (SC) justices, to reconsider its decision that dismissed his election protest against Vice President Ma. Leonor “Leni” Robredo in the 2016 vice presidential election.
In a unanimous vote of 15 justices, the PET last Feb. 16 upheld the victory of Vice President Robredo.
Seven justices voted to dismiss Marcos’ protest while eight justices voted in the result – the dismissal of the protest. The decision was written by Associate Justice Marvic M.V.F. Leonen.
In his motion for reconsideration, Marcos told the PET to “proceed with the presentation of evidence for the third cause of action.”

DEFEATED vice presidential candidate Ferdinand “Bongbong” R. Marcos, Jr. has asked the Supreme Court to reconsider the dismissal of his election protest, saying he was not given the chance to present all evidence.
“It is an integral part of procedural due process that the parties be given the opportunity to present all evidence relevant to settle all the issues involved,” he said in a 95-page motion for reconsideration.
In a separate statement, the son of the late dictator Ferdinand E. Marcos said the court sitting as the Presidential Electoral Tribunal had sacrificed his right to due process “in exchange for expediency.”

It is most respectfully prayed that the honorable Tribunal set aside the decision dated 16 February 2021.conduct another preliminary conference for the third cause of action; and thereafter proceed with the presentation of evidence for the third cause of action, Marcos said in the motion filed on May 6.
