Can a presidential petition be amended after the expiry of statutory time?
In 2016, Mohamed Mbabazi, a veteran lawyer who was representing Mr Amama Mbabazi, then the petitioner challenging President Museveni’s victory, made an oral application.
He implored the nine Justices, Bart Katureebe, Jotham Tumwesigye, Esther Kitimbo Kisaakye, Stella Arach-Amoko, Rubby Aweri-Opio, Lilian Tibatemwa-Ekirikubinza, Augustine Nshimye, Eldad Mwangusya and Faith Mwondha to allow him amend the petition out of time.

Summary
Mr Museveni also submits that his re-election for the sixth term, that will take his reign to 40 years, was conducted in accordance with the electoral laws and therefore he was validly elected.

The Supreme Court has given just two hours and 20 minutes to all the four parties to the presidential petition to make oral submissions for or against the suit filed by former presidential candidate Robert Kyagulanyi, alias Bobi Wine, who is challenging President Museveni’s election victory.
This week, Kyagulanyi also sought to amend his petition and introduced other grounds. He contends that as an incum-bent, Museveni was not supposed to take part in the January 14 presidential election.
“Contrary to Articles 102 (2) (b) and 219 of the Constitution of the Republic of Uganda as amended and S. 4 (b) of the Presidential Elections Act as amended, the 1st Respondent [Museveni] was not qualified for election as president while in the office of head of state, head of government, commander in chief and chairperson of the National Security Council,” Kyagulanyi contends.

Summary
On Monday, National Unity Platform’s (NUP) Robert Kyagulanyi, alias Bobi Wine, who came second in the January 14 presidential poll, filed in the Supreme Court a petition challenging President Museveni’s victory. Derrick Kiyonga and Joel Mukisa compare Mr Kyagulanyi’s petition with the failed 2016 petition which was filed by former prime minister Amama Mbabazi.
Use of civil servants
In his petition, Mr Mbabazi sought annulment of Mr Museveni’s election on grounds that he had used civil servants such as Jennifer Musisi, then executive director of Kampala Capital City Authority (KCCA), and Ms Allen Kagina the executive director of Uganda National Roads Authority (Unra) when the President was campaigning in the western district of Kanungu, which he said is against the law.

The National Unity Platform (NUP) presidential candidate Robert Kyagulanyi aka Bobi Wine has petitioned the Supreme court seeking for the annulment of the election victory of National Resistance Movement (NRM) presidential candidate Yoweri Museveni.
Kyagulanyi filed the petition today Monday through five law firms led by Lukwago and Company Advocates. The other firms are Pace and Company Advocates, Sewakambo and Company Advocates, Wameli and Company Advocates and Kiwanuka, Kanyango and Company Advocates. The respondents in the petition which will be determined in 60 days include Museveni, the Electoral Commission and the Attorney General.
