HELENA â Montana lawmakers are considering a bill that would limit when a business can be cited for failing an alcohol compliance check, or âsting.â
The Senate Business, Labor and Economic Affairs Committee held a hearing Wednesday on Senate Bill 129, sponsored by Sen. Greg Hertz, a Republican from Polson.
The bill deals with âcontrived events,â in which a law enforcement agency or other organization sends an underage person into a store, bar, or other business to attempt to buy alcohol.

The State of Montana is not a party to the R Bar case. The Attorney General may lack authority to âorder and directâ a county attorney to dismiss a case where a local government entity, and not the State of Montana, is the plaintiff.

The State of Montana is not a party to the R Bar case. The Attorney General may lack authority to âorder and directâ a county attorney to dismiss a case where a local government entity, and not the State of Montana, is the plaintiff.
The Attorney Generalâs letter cites a rule of civil procedure providing that all the parties may sign an agreement to dismiss a case. Today I talked to a party to the R Bar case, Health Officer Matt Kelley. Mr. Kelley does not agree to dismissal, so the rule cited by the attorney general cannot be employed to dismiss the case by noon on January 15, 2021.

Montana Attorney General Austin Knudsen on Thursday exercised his supervisory powers in the Gallatin City-County Board of Health and Health Officer Matt Kelley v. Rocking R Bar case.
Knudsen directed Gallatin County Attorney Marty Lambert to dismiss the case
against the Bozeman business that had refused to adhere to the mandate that businesses close at 10:00 p.m. The ten oâclock closure rule defies commonsense. This type of government overreach is devastating to Montana workers and small businesses, Knudsen said in a news release.
