However due to the political and constitutional impasse since April s general election, parliament has not yet convened. The Court today also warned that any attempt to obstruct the convening of parliament will be considered aso contempt of court and parliament, and would subsequently force the court to validate the invoked principle of necessity so that the business of the nation can proceed .

Political turmoil in Samoa escalates, court voids swearing-in of new MP s

FAST said it accepts the outcome of the hearing. The court said FAST’s ceremony for its 26 members has been thrown out for now, unless the order to convene parliament properly within a week is not honoured. It warned that anyone who attempts to stop the session from happening, will face court charges and that the ad-hoc ceremony would then be considered lawful if a proper session is not held on time. “Failure to convene Parliament … in our opinion would constitute a change of circumstances that would justify the Court revisiting the issue … so the business of lawful governance of the nation can proceed.”
