The appeals court concluded the circuit court lost personal jurisdiction, but rejected the defendant’s constitutional arguments, as well as the argument that circuit courts must appoint a lawyer, at county expense, when an SPD-appointed attorney is not available.
Jan. 21, 2021 – Although Wisconsin law requires a court to hold a preliminary hearing within 10 days of an initial appearance for those in custody on alleged felony charges, Nhia Lee – an indigent defendant – sat in jail for 113 days before his hearing.
He remained in custody with no lawyer to represent him because the State Public Defender (SPD) could not find private counsel to take his case. The statutory 10-day deadline for holding a preliminary hearing was repeatedly extended for this reason.

WAUSAU, WI (WSAU) A Wausau man will only spend time on probation for recklessly endangering safety after reaching a plea deal.
Yang Y. Xiong, 39-years-old will spend two years on probation after taking a plea deal. Xiong was facing charges of 1st-degree recklessly endangering safety with the use of a dangerous weapon and a domestic abuse modifier, and disorderly conduct with domestic abuse modifiers.
Police were called to a home on Colonial Road for a report of a loud argument with shots fired on May 27th. When officers arrived, they discovered an area in the front yard that appeared to show the impact of a bullet, along with a live round on the front steps and a spent round nearby. Also located near the spent round was the base plate to a Glock magazine, according to the police report.

WAUSAU, Wis. (AP) - Wausau police are recommending a reckless homicide charge against the father of a 3-month-old baby who died last week after suffering a brain injury.
The infant’s parents brought the child to Aspirus Wausau Hospital on Jan. 9, authorities said. Because of the extent of the injury and age, the baby was transferred to Marshfield Children’s Hospital for specialized care.
A criminal investigation was launched because of the unexplained, life-threatening brain injury. The infant died of his injuries on Thursday. The baby’s father was arrested the following day.
