The fifth grader was at the festival with her family. She was on a ride identified in court documents as the Super Sizzler.
Attorneys for the family allege the ride was not stopped immediately after the girl was thrown off it, resulting in further injury. McMullen died later that day at Cooper University Hospital in Camden.
A state police spokesman on Friday said the accident investigation is active.
Parents Amanda and Christopher McMullen have hired two law firms. Their attorneys have stated they are exploring wrongful death, survival action, and emotional distress lawsuits.
Cherry Hill attorney Louis DeVoto filed a request in December 2020 with the Middlesex County Superior Court for access to all state police reports. The state Attorney General s Office said the file is not considered a public record and a court order would be needed to release it, DeVoto told the court.

STATEN ISLAND, N.Y. A Mariners Harbor man once convicted here of possessing stolen property is now in trouble with the law in New Jersey.
Wesley Brissett, 34, of Union Avenue, was arrested early Wednesday morning in Bayonne and charged with burglary after allegedly breaking into a car, said police.
The incident unfolded at around 3:42 a.m. near West 56th Street, Bayonne police said.
Officers responded to a report of a man who entered a vehicle parked in a residential driveway, said police.
The alleged suspect reportedly had been seen peering into parked vehicles and checking their door handles, police said.

A lesbian firefighter in Piscataway, N.J., has filed a lawsuit against the fire company she used to work for and the township it serves, claiming she was a victim of sexual harassment on the job and subjected to a hostile work environment.
Kira Castellon sued Arbor Hose Company 1, Fire District 3, and Piscataway township last month in state Superior Court in Middlesex County.
