Police Minister Bheki Cele sat in court along with the police s top brass. Modack s supporters stood outside the court and called out to him as he left. As an armoured vehicle whisked businessman and philanthropist Nafiz Modack away from the Cape Town Magistrate s Court on Monday, some of his supporters called out: We love you Nafiz! Modack is known as someone who provides meals for impoverished families in some Cape Town suburbs. He appeared in the dock along with his co-accused, Jacques Cronje and Ricardo Morgan, while police officers lined the walls of the courtroom, bearing rifles and wearing bullet-proof vests.

Nafiz Modack will also face charges related to an attempted hand grenade attack at the house of Anti-Gang Unit Lieutenant-General Charl Kinnear in November 2019. The growing case against Modack, 30, was revealed on Monday, 3 May 2021, in the Cape Town Magistrate’s Court where the “businessman” appeared alongside co-accused Jacques Cronje, 50, and Ricardo Morgan, 36.  Police Minister Bheki Cele along with acting Western Cape police commissioner Patekile Thembisile and Major-General Jeremy Vearey, also attended the proceedings. The trio faces charges of intimidation, kidnapping, extortion, money laundering and contravention of the Electronic Communications Act. Modack is also facing charges relating to the attempted murder of prominent lawyer William Booth in April 2020.

In a letter to the Presidency, the Attorney-General, Godfred Dame, said he was satisfied that Kissi Agyebeng possesses the requisite expertise on corruption and corruption-related matters, is of high moral character and proven integrity and satisfies all the other requirements stipulated in section 13(1) and (2) of Act 959. Section 13(8) of the Office of the Special Prosecutor Act, 2017 (Act 959) requires the President to appoint a person qualified for appointment as Special Prosecutor to that position, within six months of the Office of Special Prosecutor becoming vacant. In 2019, the government-appointed Kissi Agyebeng as the Chairman of the Electronic Communications Tribunal. Agyebeng took over from Justice Samuel Kofi Date-Bah who resigned from the Tribunal on July 1, 2019.

He takes over from Martin Amidu who stepped down as the Special Prosecutor over interference in his work by President Nana Addo Dankwa Akufo-Addo in relation to the risk of corruption and anti-corruption assessment on the controversial Agyapa Royalties Transaction. Amidu alleged that the President attempted to convince him to include a response from the Minister of Finance Ken Ofori-Atta in his report which he declined because that would have compromised my independence as the Special Prosecutor. In 2019, the government-appointed Kissi Agyebeng as the Chairman of the Electronic Communications Tribunal. Agyebeng took over from Justice Samuel Kofi Date-Bah who resigned from the Tribunal on July 1, 2019.
