O Neal | Wikipedia MIAMI (Legal Newsline) - A Florida appeals court has reversed a lower court’s ruling to restore more than $400,000 in sanctions ordered against a former employee of Shaquille O’Neal and the man s lawyer, who pursued a racketeering and invasion of privacy lawsuit against the basketball star despite evidence it was a shakedown. The Third District Court of Appeal ruled that a new judge who took over the long-running case exceeded his authority when he threw out a previous judge’s sanctions order and found attorney Menachem Mayberg blameless in the affair.  “The predecessor judge supported her judgment order awarding fees with a detailed list of the sanctionable conduct” committed by Mayberg and his client Shawn Dawson, the Third Circuit ruled in a May 12 decision. “The record before us on appeal lacks any demonstration that the predecessor judge abused her discretion.”

Setai Miami Beach Sues Hotel Guest Over Amenities

(Setai) UPDATED, May 7, 2:30 p.m.: The Setai Miami Beach can’t kick out Sarah Lazow, but the luxury condo-hotel’s ownership is making the Los Angeles woman’s stay there an unpleasant one. Lazow, who currently has a short-term lease for a privately-owned unit in one of the Setai’s upper floors, is banned from the property’s pool, bars, restaurants and from using any of the amenities, according to court documents in an ongoing lawsuit in Miami-Dade Circuit Court. The hotel portions of the Setai, including the 90-room Art Deco Dempsey Vanderbilt Hotel at 2001 Collins Avenue, and some units in an adjoining 164-unit residential tower at 101 20th Street, are owned by the Nakash family that built the Jordache Jeans fashion empire.

Judge rules against lawsuit opposing Dorsey Marketplace

A lawsuit filed against the Dorsey Marketplace project last year is expected to be dismissed, according to a tentative ruling issued by a Nevada County Superior Court judge. The lawsuit was filed in August by environmental nonprofit Community Environmental Advocates and the community group Protect Grass Valley. The litigation asked the court to reverse the city’s decision to approve the Dorsey Marketplace Project and to instead order city officials to conduct a comprehensive environmental review of the project. The plaintiff’s arguments were ultimately rejected by Judge Thomas Anderson in his preliminary ruling issued on March 26. The plaintiff’s said that they are preparing to appeal Anderson’s ruling to the Third District Court of Appeal, based in Sacramento.
