Sharply split state court orders new trial for Central Pa. man convicted of rape Updated 1:08 PM; A sharply divided state Superior Court panel on Tuesday ordered a new trial for a central Pennsylvania man who is serving a 6- to 14-year prison sentence on a rape conviction. In an opinion by Judge Mary Jane Bowes, the court majority found that Colby Orner’s lawyer failed him at trial by failing to call a witness who would have testified that the alleged victim told her the rape allegation was false and that her sexual encounter with Orner was consensual. Orner, now 48, of Mount Wolf, was convicted by a York County jury in 2014 for an incident that occurred at a home in Manchester on New Year’s Eve of 2012.
