The American Civil Liberties Union filed a complaint against the Maricopa County Attorney s Office, alleging that prosecutors are misusing a pre-trial court process to get thousands to plead guilty without hearings or further evidence being disclosed.
The complaint, filed Wednesday in federal court, was brought forward by the ACLU and ACLU of Arizona. It calls into question the Attorney s Office s plea policy in the early disposition courts. The lawsuit seeks class certification and injunctive relief to stop MCAO’s retaliation policy in order to protect people’s constitutional rights, the ACLU said in a statement.
Jared Keenan, lead attorney for the case and senior staff attorney for the ACLU of Arizona, said early disposition courts are high-volume, quick-moving courts where hearings take place early in the judicial process.
